¿Qué es el Programa Unificado?

El Proyecto de Ley Senatorial 1082 (1993) estableció el Programa Regulatorio Unificado para la Gestión de Residuos y Materiales Peligrosos . Este Programa Unificado consolida, coordina y armoniza los siguientes Elementos del Programa para materiales y residuos peligrosos:

  • Generación de residuos peligrosos, incluido el tratamiento in situ según permisos escalonados
  • Ley de Almacenamiento de Petróleo sobre la Superficie (APSA)
  • Plan de prevención, control y contramedidas de derrames (SPCC)
  • Tanques de almacenamiento subterráneo (UST)
  • Planes e inventarios de respuesta ante liberaciones de materiales peligrosos
  • Programa de Prevención de Liberaciones Accidentales de California (Cal ARP)
  • Planes e inventarios de gestión de materiales peligrosos del Código Uniforme contra Incendios
¿Qué es una Agencia de Programa Unificado Certificada (CUPA)?

Una CUPA es una Agencia de Poderes Conjuntos (CUPA) aprobada y designada por Cal EPA para implementar el Programa Unificado y es responsable de los seis elementos del mismo dentro de su jurisdicción. La División de Salud Ambiental es la CUPA del Condado de Tulare.

Do I need to prepare a Hazardous Materials Business Plan (HMP)?

If your business handles or stores quantities of hazardous materials including hazardous wastes equal to or exceeding 55 gallons, 500 pounds, or 200 cubic feet of compressed gasses, an HMP is required to be completed and submitted to the Environmental Health Division.

What information do I need to include on a hazardous waste container?

Each hazardous waste container shall be labeled with the following information:

  1. Contents or common name
  2. Category of hazard, i.e. toxic, reactive, corrosive, ignitable
  3. "Hazardous Waste"
  4. Generator name and address
  5. Physical state of waste (i.e. liquid, sludge, etc)
  6. Accumulation and/or start date  
¿Quién necesita un permiso?

Se requieren permisos para las empresas que:

  • Generar, almacenar o tratar residuos peligrosos

¿Cómo denuncio un derrame o eliminación ilegal de residuos peligrosos?

Debe llamar a la División de Salud Ambiental del Condado de Tulare al (559) 624-7400 durante el horario comercial (de 7:30 a. m. a 5:30 p. m.)

Fuera del horario laboral y los fines de semana, llame a la División de Salud Ambiental al (559) 624-7400 para el servicio de contestador automático o a CalEPA al (916) 845-8911 .

También debe llamar al 911 .

¿Qué información se requiere en los contenedores de materiales peligrosos “nuevos”?

Los contenedores que contienen productos "nuevos" deben llevar la etiqueta del fabricante. Si no la hay, se debe colocar una etiqueta en el contenedor que identifique el contenido, los peligros conocidos de la sustancia química y el equipo de protección necesario para manipularla o usarla. También debe estar disponible una Hoja de Datos de Seguridad del Material (HDSM) para consulta en caso de emergencia y para la capacitación de seguridad de los empleados.

¿Dónde puedo encontrar información sobre los Planes de Gestión de Riesgos (PGR)?

Puede comunicarse con el personal de la División de Salud Ambiental de CUPA al (559) 624-7400 si tiene preguntas específicas o si las reglamentaciones que cubren los RMP están disponibles para consultar en www.caloes.ca.gov y www.epa.gov .

¿Cuándo vence mi RMP?

Se requiere que el RMP se prepare y se envíe a la División de Salud Ambiental del Condado de Tulare y a la Agencia de Protección Ambiental de los Estados Unidos a más tardar en la fecha en que el material extremadamente peligroso esté presente en el proceso por encima de las cantidades del umbral federal;

¿Qué hago con mi aceite usado?

Las empresas deben eliminar legalmente su aceite usado a través de una empresa autorizada. Los residentes pueden utilizar el Programa de Residuos Domésticos Peligrosos del Condado de Tulare . No se debe verter aceite en el suelo, las alcantarillas ni los desagües pluviales, ya que podría llegar a zonas ambientalmente sensibles y podría estar sujeto a multas si lo desecha en el sistema de desagüe pluvial.
